Bayer Men’s One-A-Day Class Action Notice Plan Approved

A California federal judge has given the green light to distribute a Class notice to California consumers covered by a class action lawsuit alleging Bayer falsely advertised the prostate health benefits of Bayer’s Men’s One-A-Day Vitamins.U.S. District Judge Anthony J. Battaglia granted a joint motion for approval of the Class notice plan, which will be published online in the next few weeks. The notice will be directed to the following Class Members:

all persons who purchased One-A-Day Men’s Health Formula from March 2002 to May 31, 2010; and
all persons who purchased One-A-Day Men’s 50+ Advantage from April 2007 to May, 31, 2010.
Plaintiffs in the One-A-Day vitamin class action lawsuit accuse Bayer of misleading consumers into believing the multivitamins – which contain selenium — support prostate health, despite scientific evidence to the contrary.According to the class action lawsuit, Bayer did not have “credible and reliable scientific support for the promise” that selenium consumption can reduce the risk of prostate cancer. It further alleged that recent clinical studies have shown that for some men, increased selenium consumption may actually increase the risk of prostate cancer.Top Class Actions will publish the Settlement Administrator website for the Bayer Men’s One-A-Day Vitamins Class Action Lawsuit once it goes live.The case is Johns v. Bayer Corp., Case No. 9-cv-1935, U.S. District Court, Southern District of California.
