A $4.5 million settlement has been proposed in the class action lawsuit entitled In re: Hepatitis A Cases, aka Hawaii Genki Sushi Hepatitis A Settlement.
Hawaii Genki Sushi Hepatitis A Class Action Settlement
Class members in the case allege that Hawaii Genki Sushi exposed them to hepatitis A after eating contaminated scallops from the Philippines at one of its 13 locations in 2016.

Who should file a claim?
Anyone that was exposed to the hepatitis A outbreak at Genki Sushi’s Oahu, Kauai, and Maui locations in 2016 through the three allowable “exposure mechanisms” and did not become infected but did receive preventative medical care including immune globulin, HAV vaccination or blood test within 14 days of being exposed to hepatitis A.
The allowable “exposure mechanisms include:
Class members who came in contact with one of the 292 people that the Hawai’I Department of Health has identified as infected with hepatitis A.
Class members that consumed food on or between Aug. 1 to Aug. 16, 2016, and were exposed to hepatitis A at one of Genki Sushi’s 13 restaurants in Oahu, Kauai, and Maui responsible for the 2016 outbreak.
Class members that consumed food or beverage from one or more of Genki Sushi’s secondary restaurants, where an employee was infected as part of the 2016 hepatitis outbreak and worked on the exposure dates.

Proof of purchase required?
Class members must show proof that they received IG, HAV vaccination, or HAV blood test. Proof can include signed documentation from a medical professional or verification through a health insurance provider.
